Terms and Conditions — BulbSync
1. Acceptance of Terms
By downloading, installing, or using the BulbSync application (hereinafter "the Application"), or by installing the BulbSync Stick firmware (hereinafter "the Firmware") on a compatible device, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not purchase, install, or use the Application or the Firmware.
2. Description of Service
BulbSync is a mobile application for Android devices that works as a wireless Bluetooth Low Energy (BLE) intervalometer and shutter remote control for compatible cameras.
With BulbSync Pro, the Application can also install the Firmware on a third-party M5Stack M5StickS3 board (hereinafter "the Stick"), which can then run a shooting session next to the camera without depending on the phone. The developer does not sell hardware: the board is purchased by you from its manufacturer or a reseller, and its hardware warranty is the manufacturer's.
3. Purchases, Payments, and Refunds
- Free version and BulbSync Pro: BulbSync is a free download through Google Play with certain limits. BulbSync Pro is an optional one-time in-app purchase, with no subscription, that removes those limits and enables the Pro features described in the Application and on its Google Play listing, including use of the Stick.
- Where Pro applies: The purchase is linked to the Google account used to make it and can be restored on any Android device signed in with that account.
- Billing: All financial transactions, payments, tax calculations (including VAT/sales tax), and processing are handled exclusively by Google LLC via Google Play. The developer does not collect or process payment credentials.
- Refund Policy: Refunds are governed directly by Google Play's refund policy. You may request a refund within the window specified by Google Play directly through your Google account.
4. Hardware Compatibility and Requirements
The Application relies on Bluetooth Low Energy (BLE) protocols to communicate with external hardware (cameras and the Stick). Compatibility depends on specific camera models, hardware configurations, and firmware versions:
- It is the user's responsibility to verify that their camera model supports Bluetooth remote control before purchasing BulbSync Pro or the Stick hardware. The compatibility list published at bulbsync.app states which models have been verified, with the phone and with the Stick; models listed as not verified may not work.
- The developer cannot guarantee uninterrupted compatibility with unverified models or with future camera firmware updates released by third-party manufacturers.
- Camera shutter modes (such as BULB mode settings) must be properly configured on the physical camera body as outlined in the application instructions for full timer functionality.
5. BulbSync Stick and Firmware
- Installation and updates: The Firmware is installed from the BulbSync website and updated from the Application over Bluetooth. Installing it replaces the software that came with the board. An update is only kept once the Stick confirms it; otherwise the Stick returns to the previous version. Even so, an interrupted installation or a hardware fault may leave the board needing to be reinstalled from the website.
- Power: The Stick runs on its internal battery or on USB-C power, including external power banks. How long it runs depends on the battery, the power source, and the session. Use power sources in good condition and follow the board manufacturer's instructions.
- Unattended sessions: A session run by the Stick continues without the phone. Its screen, sound alerts, and the progress rebuilt by the Application are aids, not a guarantee that every shot is taken.
6. Intellectual Property and License
The Application and the Firmware, including their source code, design, logos, UI assets, and documentation, are the exclusive intellectual property of David Garcia Gonzalez. All rights are reserved.
You are granted a personal, non-exclusive, non-transferable license to use the Application on Android devices linked to your Google account, and to install and use the Firmware on Stick devices that you own or control, in both cases only together with the Application. You may not copy, modify, distribute, sell, rent, or create derivative works of the Application or the Firmware, or decompile or reverse engineer them, except to the extent that applicable law expressly permits it.
Disclaimer: "Sony", "Sony Alpha", "Canon", "EOS", "Nikon", "Fujifilm", "Ricoh", "M5Stack", "M5StickS3", and related product names are trademarks or registered trademarks of their respective owners. BulbSync is an independent product and is not affiliated with, endorsed by, or sponsored by any of them.
7. Limitation of Liability
The Application and the Firmware are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied. To the maximum extent permitted by applicable law:
- The developer shall not be liable for any indirect, incidental, or consequential damages resulting from the use or inability to use the Application, the Firmware, or the Stick.
- The developer is not responsible for missed photographic opportunities, battery depletion, signal loss, or equipment setup errors occurring during shooting sessions, whether run from the phone or from the Stick.
- You are responsible for monitoring your camera equipment, the Stick, its power source, and your environment safely during outdoor, night, or unattended sessions.
Nothing in these Terms limits the rights you have as a consumer under applicable law.
8. Support and Updates
The developer strives to provide maintenance updates, bug fixes, and compatibility improvements for the Application and the Firmware. Technical support inquiry requests can be submitted to support@bulbsync.com.
9. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of Spain and applicable European Union regulations, without regard to conflict of law principles.
Términos y Condiciones de Uso — BulbSync
1. Aceptación de los Términos
Al descargar, instalar o utilizar la aplicación BulbSync (en adelante, "la Aplicación"), o al instalar el firmware de BulbSync Stick (en adelante, "el Firmware") en un dispositivo compatible, aceptas quedar vinculado por los presentes Términos y Condiciones. Si no estás de acuerdo con alguno de estos términos, por favor no compres, instales ni utilices la Aplicación ni el Firmware.
2. Descripción del Servicio
BulbSync es una aplicación móvil para dispositivos Android que funciona como intervalómetro inalámbrico por Bluetooth Low Energy (BLE) y mando de disparo remoto para cámaras compatibles.
Con BulbSync Pro, la Aplicación puede además instalar el Firmware en una placa M5Stack M5StickS3 de terceros (en adelante, "el Stick"), que puede ejecutar una sesión de disparos junto a la cámara sin depender del teléfono. El desarrollador no vende hardware: la placa la compras tú a su fabricante o a un distribuidor, y la garantía del hardware es la de su fabricante.
3. Compras, Pagos y Devoluciones
- Versión gratuita y BulbSync Pro: BulbSync se descarga gratis desde Google Play, con ciertos límites. BulbSync Pro es una compra única y opcional dentro de la aplicación, sin suscripción, que elimina esos límites y activa las funciones Pro descritas en la Aplicación y en su ficha de Google Play, incluido el uso del Stick.
- Alcance de Pro: La compra queda vinculada a la cuenta de Google con la que se realiza y se puede restaurar en cualquier dispositivo Android con esa misma cuenta.
- Facturación: Todas las transacciones económicas, pagos, cálculo de impuestos (IVA) y procesamientos son gestionados exclusivamente por Google LLC a través de Google Play. El desarrollador no recopila ni procesa datos de pago.
- Política de reembolsos: Las devoluciones se rigen por la política de reembolsos de Google Play. Puedes solicitar la devolución dentro del plazo establecido por Google directamente desde tu cuenta de Google Play.
4. Compatibilidad de Hardware y Requisitos
La Aplicación utiliza el protocolo Bluetooth Low Energy (BLE) para comunicarse con equipos externos (cámaras y el Stick). La compatibilidad depende del modelo exacto de cámara y de su versión de firmware:
- Es responsabilidad del usuario verificar que su modelo de cámara dispone de control remoto por Bluetooth antes de comprar BulbSync Pro o el hardware del Stick. La lista de compatibilidad publicada en bulbsync.app indica qué modelos se han verificado, con el teléfono y con el Stick; los que figuran como no verificados pueden no funcionar.
- El desarrollador no puede garantizar la compatibilidad ininterrumpida con modelos no verificados o con futuras actualizaciones de firmware lanzadas por los fabricantes de las cámaras.
- Ciertos modos de disparo (como el modo BULB) deben configurarse correctamente en el cuerpo de la cámara física según las instrucciones de la aplicación para un correcto funcionamiento.
5. BulbSync Stick y Firmware
- Instalación y actualizaciones: El Firmware se instala desde la web de BulbSync y se actualiza desde la Aplicación por Bluetooth. Al instalarlo se sustituye el software que traía la placa. Una actualización solo se conserva cuando el Stick la confirma; si no, el Stick vuelve a la versión anterior. Aun así, una instalación interrumpida o un fallo del hardware pueden obligar a reinstalarlo desde la web.
- Alimentación: El Stick funciona con su batería interna o alimentado por USB-C, también con baterías externas. Cuánto dura depende de la batería, de la fuente de alimentación y de la sesión. Usa fuentes de alimentación en buen estado y sigue las instrucciones del fabricante de la placa.
- Sesiones sin supervisión: Una sesión que ejecuta el Stick continúa sin el teléfono. Su pantalla, sus avisos sonoros y el avance que reconstruye la Aplicación son ayudas, no una garantía de que se realicen todas las tomas.
6. Propiedad Intelectual y Licencia
La Aplicación y el Firmware, incluidos su código fuente, diseño, logotipos, recursos de interfaz y documentación, son propiedad intelectual exclusiva de David Garcia Gonzalez. Todos los derechos reservados.
Se te otorga una licencia personal, no exclusiva e intransferible para usar la Aplicación en dispositivos Android vinculados a tu cuenta de Google, y para instalar y usar el Firmware en dispositivos Stick que sean tuyos o estén bajo tu control, en ambos casos solo junto con la Aplicación. No puedes copiar, modificar, distribuir, vender, alquilar ni crear obras derivadas de la Aplicación o del Firmware, ni descompilarlos o aplicarles ingeniería inversa, salvo en la medida en que la ley aplicable lo permita expresamente.
Aviso legal: "Sony", "Sony Alpha", "Canon", "EOS", "Nikon", "Fujifilm", "Ricoh", "M5Stack", "M5StickS3" y los nombres de producto relacionados son marcas comerciales o marcas registradas de sus respectivos titulares. BulbSync es un producto independiente y no está afiliado, respaldado ni patrocinado por ninguno de ellos.
7. Limitación de Responsabilidad
La Aplicación y el Firmware se proporcionan "TAL CUAL" y "SEGÚN DISPONIBILIDAD", sin garantías de ningún tipo, explícitas o implícitas. En la máxima medida permitida por la ley aplicable:
- El desarrollador no se hace responsable de daños indirectos, incidentales o derivados del uso o la imposibilidad de uso de la Aplicación, del Firmware o del Stick.
- El desarrollador no se responsabiliza por tomas no ejecutadas, agotamiento de baterías, pérdidas de señal Bluetooth o errores en la configuración del equipo durante las sesiones fotográficas, ya se ejecuten desde el teléfono o desde el Stick.
- El usuario es responsable de supervisar adecuadamente su equipo fotográfico, el Stick, su fuente de alimentación y su entorno durante las sesiones nocturnas, en exteriores o sin supervisión.
Nada de lo dispuesto en estos Términos limita los derechos que te reconoce como consumidor la legislación aplicable.
8. Soporte y Actualizaciones
El desarrollador trabaja para ofrecer actualizaciones de mantenimiento, corrección de errores y mejoras de compatibilidad para la Aplicación y el Firmware. Para consultas técnicas o soporte, puedes escribir a support@bulbsync.com.
9. Legislación Aplicable
Estos Términos y Condiciones se rigen e interpretan de acuerdo con las leyes de España y la normativa aplicable de la Unión Europea.
